Indemnification

Governing Law and Jurisdiction

All matters relating to the Website and these Terms of Use and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Utah without giving effect to any choice or conflict of law provision or rule (whether of the State of Utah or any other jurisdiction).

Any legal suit, action or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Utah in each case located in the City of Salt Lake and County of Salt Lake, although we retain the right to bring any suit, action or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED. 

Waiver and Severability

No waiver of by the Company of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

Entire Agreement

The Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and Real Estate Investors Club, LLC with respect to the Website and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Website.

This privacy policy (“Privacy Policy”) discloses what information Done For You Real Estate, and Strategic Lending, LLC (the “Company,” “we” or “us”) gathers about you through its website (the “Website”), however accessed, and how that information is used. The Company owns and operates the Website, and we use the personal information we receive from it as described below. We do not sell your personal information. 

By using the Website and sharing your information with us, you consent to and accept the privacy practices described in this Privacy Policy.

At Strategic Lending, we respect your privacy and understand that the personal information you provide is extremely sensitive. We are disclosing the following privacy policy to comply with the Gramm-Leach-Bliley Act that governs the privacy of consumer financial information. This policy serves as a standard for all Strategic Lending employees for the collection, use, retention, and security of nonpublic personal information.
 
"Non-public personal information" is nonpublic information about you that we obtain in connection with providing a financial product or service to you.
 
We take our clients' financial privacy very seriously. During the course of processing your application, we accumulate non-public personal financial information from you and from other sources about your income, your assets, and your credit history in order to allow a lender to make an informed decision about granting you credit. 
 

We may disclose certain nonpublic personal information about you to third parties. For example, we may disclose nonpublic personal information about you to government entities in response to subpoenas, or to credit reporting agencies. Also, as permitted by federal and state laws, we may share or exchange nonpublic personal information about you which we have collected, to companies that perform marketing services on our behalf or to other financial institutions with whom we have joint marketing agreements. These other entities may include but are not limited to Strongbrook REIC, LLC, The Real Estate Firm, LLC (TREF), The Financial Firm, LLC (TFF), The Companies, LLC, and Bank of American Fork.

We collect nonpublic information about you from the following sources: (i) information we receive from you on applications or other forms; (ii) information about your transactions with us, our affiliates, or others; and (iii) information we receive from a consumer reporting agency.

We do not disclose any nonpublic information about our customers or former customers to any third party, except as permitted by law and stated in this privacy policy.
